Lawsuit Information
Ben Pham, a Wild Plum Valley resident shared a letter he received just a few days before Christmas in 2019. He was asked to fix multiple deed restrictions by January 17th. You can view the below letter. It also said if the violations are not fixed by January 17th a lawsuit could be filed against him and additionally he could be liable for attorney fees.
In May of 2021, things were taken a step further and one owner in Wild Plum Valley is suing two other owners in Wild Plum Valley over violations of the deed restrictions. In both cases the owner is suing for monetary relief of $250,000 or less and non-monetary relief. This includes statutory damages of $200 per day. They are also asking for an additional sum to compensate them for attorney’s fees and costs incurred in this lawsuit. You can see the details of the cases in the documents below.

On July 14th, 2021 for Case No. 21-0706-C395, a counter claim was made seeking monetary relief of $250,000.00 or less and non-monetary relief.
